Digital Millennium Copyright Act Policy

1. Introduction

FILE PULLER respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our service.

2. Notice and Takedown Procedure

If you are a copyright owner or authorized to act on behalf of one, and you believe that your work has been copied in a way that constitutes copyright infringement, please submit a DMCA takedown notice to our designated agent.

3. Filing a DMCA Notice

To file a DMCA notice, you must provide the following information in writing:

Required Information:
  1. Identification of the copyrighted work: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the infringing material: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Location of the infringing material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  4. Contact information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  5. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
  7. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

4. Submit DMCA Notice

5. Counter-Notification Procedure

If you believe your content was removed in error, you may submit a counter-notification. To be effective, your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that has been removed or to which access has been disabled
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, for any judicial district in which FILE PULLER may be found
  6. A statement that you will accept service of process from the person who provided the original DMCA notice or an agent of such person

6. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. We reserve the right to terminate accounts of users who we determine, in our sole discretion, are repeat infringers.

7. Service Provider Status

FILE PULLER is a service provider as defined by the DMCA. We do not control the content uploaded by users. We act as an intermediary and are protected by the safe harbor provisions of the DMCA.
